Copy them from BP default and run through whatever steps you did to make them compatible with your theme, but do this as a child theme  then you shouldn’t lose your customizations.

If pretty permalinks are working then it’s not an issue with mod_rewrite.

Yes may well be, even if it is a current stable stream , some hosts won’t have moved off 5.2.* so you may well exlude people personally I wouldn’t restrict things in this manner.
